ADP is hiring a 401(k) Compliance Manager. In this position you will manage personnel resources to ensure delivery of quality and timely compliance services to our clients. Organize, assign, direct, and participate in committees or major projects responsible for enhancing services and improving efficiency (resource optimization). Serve as resource for Compliance and other Departments concerning regulatory testing, systems, reporting and disclosure. Manage human resource issues for the assigned department. Provide a critical communications link between higher management and compliance staff to provide important plan level services that safeguard the qualification of the client’s plan with the Internal Revenue Service.

RESPONSIBILITIES:
- Oversees the timeliness and quality of Compliance services.
- Provides leadership to staff through mentoring, coaching, and taking appropriate disciplinary action when necessary.
- General human resource management including training needs assessment.
- Manages systems projects that provide compliance definition, needs, and requirements to key systems personnel for systems enhancements.
- Oversees and participates in user testing.
- Analyzes and recommends changes to operational procedures to ensure compliance with regulatory changes and operational effectiveness.
- Responsible for communication and coordination with other areas to ensure proper client support.
- Resolves plan qualification issues and client dissatisfaction issues when appropriate.
- Assigns and oversees progress of all department projects assigned to staff.
- Assists Director in analyzing, forecasting, and planning for budget and staffing.
- Perform other related duties as assigned.
QUALIFICATIONS REQUIRED:
- Bachelor’s Degree in Human Resource Management, Accounting, or Business Administration (or equivalent experience) and knowledge of the Sungard systems are preferred.
- Minimum of 6+ years of qualified plan compliance, record keeping, administration, and management.
Preference will be given to candidates who have the following:
- A designation from the American Society of Pension Actuaries (i.e., QPA or CPC) or from the Wharton School of Business (i.e., CEBS) is a plus (or equivalent in education and experience).
- Considerable knowledge of nondiscrimination, minimum coverage, top heavy, and annual additions testing as well as Annual Report (5500 forms) preferred.
- Experience in successfully managing compliance related projects.
- Nondiscrimination testing under Sections 401(k) and 401(m) of the Internal Revenue Code (IRC).
- Minimum coverage testing under Section 410(b) of the IRC.
- Nondiscrimination requirements under IRC 401(a)(4) of the IRC.
- Top heavy testing under Sec. 416 of the IRC.
- Annual additions testing under Sec. 415 of the IRC.
- Reporting and disclosure requirements under the Employee Retirement Income Security Act (ERISA) and the IRC, in particular 5500 forms and Summary Annual Report (SAR).
- Safe Harbor 401(k) rules allowing plans to avoid specific types of testing.
- Record keeping and administrative rules and regulations under IRC and Dept. of Labor, such as, distribution rules, vesting rules, and the allocation of contributions.
- Current changes to the rules and regulations governing qualified plans and with our internal processes, policies, and procedures.
- Conversion plan issues and procedures, in particular Annual Report financial reconciliation procedures.
